                   	     ORDINANCE NO. 10312
                  
                  
                   AN ORDINANCE CLOSING AND ABANDONING AN ALLEY
                   LOCATED SOUTHWEST FROM EAST 3RD STREET,
                   SOUTHEAST OF NORTH HOLLY STREET, MORE
                   PARTICULARLY DESCRIBED HEREIN, UPON CERTAIN
                   CONDITIONS.

              	   SECTION 1.  BE IT ORDAINED BY THE CITY COUNCIL OF THE
         CITY OF CHATTANOOGA, TENNESSEE, That there be and is hereby 
closed
         and abandoned an alley located southwest from East 3rd Street,
         southeast of North Holly Street, more particularly described
         herein, and as shown on plat attached hereto and made a part
         hereof by reference:
               
                A 10 foot wide unopened alleyway beginning on the
                southwest line of East 3rd Street 317.5 feet
                southeast of the intersection of the southwest line
                of East 3rd Street with the southeast line of North
                Holly Street, and extending southwest some 192.5
                feet between parallel lines, and parallel to North
                Holly Street, to the northeast line of East 4th
                Street (abandoned by City of Chattanooga Ordinance
                No. 8596).  Said alleyway separates lots 1 and 11,
                J.E. Edington's Subdivision, as shown by plat of
                record in plat book 6, page 58, ROHC, from lot 1,
                Pyotts and Stanleys Subdivision, as shown by plat
                of record in plat book 2, page 11, ROHC, and lot
                28, Moore and Laniers Subdivision, as shown by plat
                of record in plat book 5, page 6, ROHC.  Tax Map
                No. 146F-S-1.1 and 146G-H-1.

              	   SECTION 2.  BE IT FURTHER ORDAINED, That this closure
         and abandonment is made subject to the following conditions:
        
                1. The City of Chattanooga has a sewer located
                   within said right-of-way and reserves an
                   easement the width of the right-of-way for the
                   purpose of maintaining said sewer.
               
                2. The areas reserved for utility easements must be
                   kept free and clear of all structures.
               
                3. All existing easements are retained.
               
               
              	   SECTION 3.  BE IT FURTHER ORDAINED, That this 
Ordinance
         shall take effect two weeks from and after its passage as 
provided
         by law.
